Landlord and agent questions
What are the new Scottish damp and mould duties?
The Investigation and Commencement of Repair (Scotland) Regulations 2026, often referred to as Awaab's Law, come into force on 6 October 2026 and apply to private and social landlords in Scotland. Where damp or mould is reported, an investigation must be completed by a competent person within 10 working days of the landlord being notified of, or becoming aware of, the damp or mould; a written summary of the findings must be provided within 3 working days of the investigation being completed; and where a qualifying repair is identified it must be commenced within 5 working days of the investigation, subject to the circumstances set out in the regulations, including those beyond the landlord's control.
Does DAMP SOLVE certify compliance with the regulations?
No. We carry out physical investigations, issue written findings with photographs and readings, and install condensation and moisture-control solutions where appropriate. We do not issue compliance certificates, guarantee compliance or give legal advice. The statutory duties remain with the landlord.
Does fitting an extractor fan satisfy the regulations?
No. Installing ventilation may be the right remedial action where the evidence supports it, but it does not automatically discharge a landlord's statutory duties. Each case depends on what the investigation finds and what repair is required.
